These Terms & Conditions (“Terms”) govern access to and use of the Clientish platform (the “Service”), operated by Clientish Co Inc (“Clientish”, “we”, “us”, or “our”). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
Clientish is a software-as-a-service platform that helps agencies manage clients, orders, tasks, tickets, invoicing, team members, and related workflows. We may add, modify, or remove features at our discretion.
2. Account Registration
You must provide accurate, current information when creating an account and are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account, including actions taken by team members, remote members, or clients you invite into your workspace.
3. Free Trial, Subscriptions & Billing
New workspaces receive a 14-day free trial with full feature access and no credit card required. At the end of the trial, you may subscribe to a paid plan to continue using the Service. Once you subscribe to a paid plan, payments are billed in advance on a recurring basis (monthly or annually, as selected) and are non-refundable, including for partial billing periods, downgrades, or unused time. You may cancel your subscription at any time; cancellation takes effect at the end of your current billing period.
We reserve the right to change our pricing with at least 30 days’ notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.
4. What Happens When Access Lapses
End of the free trial. When the 14-day trial expires without a paid subscription, workspace access ends. Your data is retained for a limited period so you can subscribe and pick up where you left off, but you cannot sign in or use the Service until a plan is active.
Lapsed paid subscription. If a renewal payment fails or is not made, your workspace enters a 90-day read-only grace period. During those 90 days you can still sign in and view everything — clients, orders, invoices, tickets, files, and reports — and export your data. You cannot create, edit, delete, or send anything, and your client portal and public forms stop accepting new submissions.
Renewing at any point within the 90 days restores full access immediately with nothing lost. If the subscription is still unpaid when the grace period ends, the workspace and its data may be permanently deleted. The read-only grace period is provided so you can export your records; it does not create any entitlement to a refund or credit — see our Refund Policy.
5. Payment Processing
Payments are processed through third-party payment gateways, including Stripe, PayPal, Paddle, Aamarpay, and SSLCommerz, as well as manual bank transfers where supported. Clientish does not store full payment card numbers; card data is handled directly by our payment processors in accordance with their own terms and security standards.
6. Your Data & Content
You retain all ownership rights to the client records, orders, files, messages, and other content you or your team upload to your workspace (“Customer Data”). You grant Clientish a limited license to host, process, and display Customer Data solely to operate and improve the Service. You are responsible for ensuring you have the right to upload any data you submit, including data belonging to your own clients.
7. Intellectual Property
The Service, including its software, design, trademarks, and branding, is the exclusive property of Clientish Co Inc and is protected by intellectual property laws. Nothing in these Terms grants you any rights to Clientish’s trademarks, logos, or proprietary technology beyond the limited right to use the Service as intended.
8. Acceptable Use
You agree not to use the Service to: violate any applicable law; infringe on intellectual property rights; transmit malware or unauthorized code; attempt to gain unauthorized access to any part of the Service; or resell or sublicense the Service without our written consent.
9. Plan Limits
Each subscription tier includes specific limits on team members, clients, orders, tickets, remote teams, and other resources, as described on our Pricing page. We will notify you before you exceed a plan limit so you can upgrade; we do not disable access without warning.
10. Termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay applicable fees, or use the Service in a way that creates legal liability or harms other users. Upon termination, your right to use the Service ends immediately; we will retain Customer Data for a limited period as described in our Privacy Policy to allow for export or recovery.
11. Disclaimers & Limitation of Liability
The Service is provided “as is” without warranties of any kind, express or implied. To the fullest extent permitted by law, Clientish Co Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws applicable to Clientish Co Inc, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the jurisdiction where Clientish Co Inc is registered.
